  • The Death Penalty and Intellectual Disability

The Death Penalty and Intellectual Disability is the authoritative resource on the application of diagnostic information concerning intellectual disability (ID) in death penalty cases, and will be useful to all professionals involved in ID determination processes within the criminal justice system.

In a landmark Atkins v. Virginia decision in 2002, the U.S. Supreme Court ruled that executing someone with ID is a violation of the Eighth Amendment of the U.S. Constitution, which prohibits cruel and unusual punishment. In its 2014 Hall v. Florida decision, the Court ruled that, while states have the right to establish their own rules for handling Atkins cases, they cannot ignore scientific and medical consensus on the diagnosis of ID, which considers both IQ test scores and measures of adaptive behavior.

The publication addresses the following critical topics:

    • The definition of ID, diagnostic criteria, and analyses of Atkins cases
    • Assessment considerations
    • Intellectual functioning, including IQ testing and the Flynn effect
    • Adaptive behavior

Also discussed are related topics including cultural and linguistic considerations,  competence to waive Miranda rights and to stand trial, retrospective diagnosis, malingering, comorbid disorders, educational records, and professional issues.

State of the States in Intellectual and Developmental...

The State of the States in Intellectual and Developmental Disabilities, 11th Ed. is a thorough and one-of-a-kind analytical study of public spending and programmatic trends in intellectual and developmental disability (IDD) services across the United States.

In this 11th edition, extensive analyses are presented on each state’s performance over a period of 40 years, ending with fiscal year 2015. As in previous editions, this edition provides statistical profiles for each of the 50 states and the District of Columbia, as well as for the country as a whole.

      Data presented include:

      • Out-of-home placements
      • Federal, state, and local Medicaid spending
      • Fiscal effort (a state’s spending for IDD services from federal, state, and local sources per $1,000 aggregate statewide personal income);
      • Annual cost of care across years for individuals residing in five different settings

Authors predict future demographic and legal forces, implications of changes to Medicaid, and key challenges of the future.

      • Forging a Federal-State Partnership:A History of Stat...

Forging a Federal-State Partnership provides an insider’s view of how the federal government assumed a dominant role in disability policy between the Kennedy and Obama eras.

The book highlights the roles played by the federal government and the states in disability policy, focusing on the emergence of Medicaid as the primary funding source for IDD services. It offers a unique perspective on the evolution of public policy which is missing from most renditions of disability history, written by a close observer of the events as they unfolded.

Policymakers, students, and those involved in governmental advocacy will find its historical perspective and insights useful in their work.

            • Health Promotion for Persons with Intellectual and De...

While promoting good health among people with intellectual disability (ID) is much discussed as a public priority, there is no literature that recapitulates the state of the science in the area of health promotion for people with intellectual and developmental disabilities. This publication, based on a national conference conducted by AAIDD (Formerly AAMR), summarizes current research on 14 topics that affect the health and well being of people with ID in the hope of informing research, policy, clinical, and health care initiatives. The book provides a solid basis for developing interventions and solutions to eliminate health disparities among people with ID. The topics explored in this report are: hypertension; obesity; swallowing dysfunction/dysphagia; epilepsy; mental health; physical activity and fitness; women’s health; safety/injury and violence; case management and care coordination; alternative and complementary medicine; tobacco and substance abuse; secondary conditions risk appraisal for adults; and general health of people with ID.
